Terms and Conditions

Welcome to butchstitch.com. These terms cover how you use this site and what happens when you buy something from it. They’re a contract between you and Butch Stitch, so it’s worth a read before you order.
By browsing this site, creating an account, or placing an order, you agree to these terms. If you don’t agree with them, please don’t use the site.

1. Who can use this site

You must be at least 18 years old, or the age of majority where you live — whichever is higher — to buy from this site or to view the X-rated Shop. The X-rated Shop contains explicit erotic artwork depicting the male form and sexual activity between adults. By entering that section of the site you confirm that you are of legal age, that viewing this material is lawful where you are, and that you are choosing to view it. If any of that isn’t true, don’t enter it. You’re responsible for making sure it’s legal to receive this artwork where you live. Some countries restrict the import of explicit material. We don’t provide legal advice on this and we can’t refund an order seized by customs. If you’re unsure, ask us before you buy and we’ll tell you what we know about shipping to your country.

2. The artwork

That means a few things worth stating plainly:

 

No two pieces are identical.Even where a design is revisited, each work differs in thread, tension, and hand. Slight irregularities are inherent to the medium, not defects. Hand-stitched work has variation in it. That’s the point. Colours shift between screens. Your monitor, phone, and lighting will all render thread colour differently from how it looks in the room. We photograph work as accurately as we can, but we can’t guarantee an exact match to what you see on your device. Once a piece is sold, it’s gone. Originals are not reproduced. If a listing is still visible after a sale, that’s a caching or timing lag, not a second copy.

 

Frames are sold separately unless a listing says otherwise. Framed dimensions and materials are listed on each frame product page.

3. Prices, currency, and taxes

All prices are shown in Canadian Dollars and are exclusive of applicable taxes unless stated otherwise at checkout.

Butchstitch is not currently registered for GST/HST, so no Canadian sales tax is charged on orders.

International orders may attract customs duties, import taxes, or brokerage fees on arrival. These are set by your country, not by us, they are not included in the price or the shipping cost, and they’re yours to pay. Refusing a delivery to avoid these charges doesn’t entitle you to a refund of shipping.

We may change prices at any time. The price that applies to your order is the one displayed when you complete checkout.

4. Orders

Placing an order is an offer to buy, not a completed sale. The contract forms when we send you an order confirmation and accept your payment.

We may decline or cancel an order, and refund you in full, if:

– the piece has already sold,
– a price or description was listed in error,
– we can’t verify your payment or billing details,
– we can’t lawfully ship to your address, or
– we have reasonable grounds to believe the order is fraudulent or intended for resale in breach of section 7.

Obvious pricing errors are not binding on us. If a $795 original briefly appears at $7.95, that’s a mistake, and we’ll cancel and refund rather than honour it.

5. Payment

Payment is taken in full at checkout through our payment processor. We don’t see or store your full card details — those are handled by the processor under their own terms and privacy policy.

6. Shipping, delivery, and risk

Shipping timeframes, carriers, and costs are set out on our [Shipping & Delivery page](https://butchstitch.com/help-info/), which forms part of these terms.

Delivery estimates are estimates. Once a parcel is with the carrier, its progress is out of our hands, and we’re not liable for delays caused by carriers, customs, weather, or strikes.

Risk of loss or damage passes to you on delivery to the address you gave us. If a piece arrives damaged, tell us within [X] days with photographs of the work and the packaging so we can make a claim — see the Refunds and Returns page for what happens next.

Make sure your shipping address is right. We can’t redirect a parcel once it’s dispatched, and we’re not responsible for work delivered correctly to an address you entered incorrectly.

7. Copyright and what you're buying

When you buy an original, you’re buying the physical object. You are not buying the copyright.

 

Butchstitch retains all copyright and intellectual property rights in every artwork, including the design, composition, and all images of the work. Nothing in a sale transfers, licenses, or assigns those rights to you.

 

You may:  display the work privately or publicly, resell or gift the physical piece, and share photographs of it on social media with credit to Butch Stitch.

 

You may not:  reproduce the work or its design in any medium, produce prints, patterns, charts, or merchandise from it, use images of it commercially, or use it to train machine learning models or generative AI systems. This applies equally to images on this website, whether or not you’ve bought anything.

 

Under the Copyright Act (Canada), the artist retains moral rights in each work. You agree not to alter, distort, or mutilate a piece, or use it in association with a product, cause, or institution, in a way prejudicial to the artist’s honour or reputation.

 

The Butchstitch name, logo, site text, and photography are likewise ours. Don’t copy them.

8. Commissions

Commissioned work is subject to these terms plus anything specifically agreed in writing between us.

 

– A commission begins only once we’ve agreed the subject, size, timeline, and price in writing.
– A deposit of 50% is payable up front. **This deposit is non-refundable** once work has begun, because hand-stitching a commissioned piece can’t be undone or resold as-is.
– The balance is due before shipping.
– Timelines are estimates. This work is slow by nature and we’d rather be honest about that than rush a piece.
– We may decline any commission request, for any reason, without explanation.
– Copyright in commissioned work remains with the artist under section 7 unless we agree otherwise in writing.

 

**If you send reference photographs,** you confirm that: you own or have permission to use them; every person depicted is at least 18 years old and has consented to their likeness being used in an artwork that may be explicit; and you have the right to grant us permission to work from the images. You agree to indemnify us against any claim arising from reference material you supply.

 

We may decline to work from any reference we’re not comfortable with, and we may ask for proof of consent or age. We won’t work from images of identifiable people without confirmation that they’ve agreed.

 

Unless you tell us otherwise in writing, we may photograph finished commissions and show them in our portfolio and on social media. If you’d like a piece kept private, just say so before we start.

9. Returns and refunds

Our [ Refunds and Returns policy ] forms part of these terms and sets out what can be returned, in what condition, and by when.

 

Nothing in these terms limits any rights you have under the *Business Practices and Consumer Protection Act* (British Columbia), the *Sale of Goods Act*, or other consumer protection legislation that can’t be waived by agreement.

10. Using this site

Please don’t:

– copy, scrape, or systematically download content from the site,
– use automated tools to harvest images or data, including for AI training datasets,
– interfere with the site’s security or try to access areas you’re not authorised to reach,
– submit false information or use someone else’s payment details, or
– use the site for anything unlawful.
If you create an account, you’re responsible for keeping your password secure and for activity that happens under it. Tell us if you think someone else has access.
We may suspend or close an account, or refuse service, if these terms are breached.

11. Links to other sites

This site links to third-party platforms including Instagram and Pinterest. We don’t control those sites and aren’t responsible for their content, terms, or privacy practices.

12. Availability of the site

We aim to keep the site running, but we don’t guarantee it will be available uninterrupted or error-free. We may change, suspend, or withdraw any part of it, including individual listings, without notice.

13. Disclaimers and limitation of liability

The site and its content are provided as they are. To the extent permitted by law, we exclude implied warranties and conditions other than those that cannot lawfully be excluded.

To the extent permitted by law, our total liability to you arising out of or connected with your use of this site or any purchase is limited to the amount you paid for the item in question. We are not liable for indirect, incidental, or consequential losses, including lost profits or loss of data.

We do not exclude or limit liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or anything else that cannot lawfully be excluded.

Again: nothing here removes consumer rights that BC law says can’t be removed.

14. Indemnity

You agree to indemnify us against claims, losses, and reasonable legal costs arising from your breach of these terms, your misuse of the site, or reference material you supply to us.

15. Privacy

How we handle your personal information is set out in our [ Privacy Policy ].

16. Changes to these terms

We may update these terms. The version that applies to your order is the one published when you placed it. We’ll update the “last updated” date at the top when we make changes, and material changes will be flagged on the site.

17. Governing law

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there. Disputes will be dealt with by the courts of British Columbia, though this doesn’t remove any right you may have to bring a claim in the courts of your own country where consumer law gives you that right.

18. General

If any part of these terms is found unenforceable, the rest continues to apply. Our not enforcing a term on one occasion doesn’t waive it. These terms, together with the Refunds and Returns policy, Shipping & Delivery page, and Privacy Policy, are the whole agreement between us about your use of this site.
